Paul,

Re your hit-run dooring. Have you contacted the police and been officially informed that the driver was cautioned and will not be charged (rather than via TV)? Have you contacted Police Complaints Authority, location 50 Grenfell Street, Adelaide SA 5000, address GPO Box 464, Adelaide SA 5001, phone (08) 8226 8677.

You cycle in the CBD so an invite to join Adelaide BUG which has an emphasis on cycling advocacy. I coordinate the group and am willing to contact politicians.

Cheers, Heather

Hi Paul,

Below is an item from the draft BUG News Apr-2012. Do you want to add anything? I added to the AC discussion contact details for Police Complaints Authority. 50 Grenfell Street, Adelaide SA 5000. GPO Box 464, Adelaide SA 5001. Phone (08) 8226 8677. Did you write to them with copy to pertinent politicians?

Cheers, Heather

Adelaide cyclist injured in hit-run but driver not charged
A member of Adelaide Cyclists was injured in a hit-run dooring on Friday 9-Mar-2012 on Pulteney Street. He provided film of the incident that was shown on channels 7, 9 and 10.
Why was the driver only cautioned? An outcome of a hit-run near Adelaide where cyclist Ian Humphrey died (driver was lawyer and ex-police officer Eugene McGee) was tougher laws for hit-run drivers. Are these laws being ignored by authorities like SAPOL? –

Pertinent Australian Road Rules under the Road Traffic Act 1961
http://www.austlii.edu.au/au/legis/sa/consol_reg/arr210/s269.html
269—Opening doors and getting out of a vehicle etc
(3) A person must not cause a hazard to any person or vehicle by opening a door of a vehicle, leaving a door of a vehicle open, or getting off, or out of, a vehicle.

http://www.austlii.edu.au/au/legis/sa/consol_act/rta1961111/s43.html
43—Duty to stop, give assistance and present to police where person killed or injured
Penalty is disqualification of holding a driver's licence being not less than 1 year. In the case of a first offence, the court is satisfied that the offence is trifling, in which case it may order a period of disqualification that is less than the prescribed minimum period but not less than one month.

Note: If the incident is considered trifling, in theory the driver has their licence suspended for a least one month. Dooring a cyclist is not necessarily a trifling offence. In Melbourne a cyclist was killed when a driver opened a car door, and again the driver was not charged. When will authorities take seriously cyclist safety, their responsibilities and Australian laws?

Paul, saw you on TV. Started a discussion at http://www.adelaidecyclists.com/forum/topics/15-mar-2012-6pm-on-ch-7-news before I realised it was your dooring incident about to be shown on TV. On my post, a cyclist asked what was the point of new hit-run legislation that Senator Nick Xenophon played a role in. This morning I phoned Nick's office, said your filmed incident where driver only cautioned showed system not working, and spoke of related things. The assistant will determine if he will follow this up with me.
